Please read these Terms of Service ("Terms") carefully before using the MezbanPOS website at mezbanpos.com ("Website") or the MezbanPOS desktop application ("Software"), operated by MezbanPOS ("we," "us," "our"). By accessing the Website or downloading/using the Software, you agree to be bound by these Terms.
1. Definitions
- "Software" refers to the MezbanPOS desktop application available for Windows, macOS, and Linux.
- "Service" refers to the Software, Website, and any related support or updates we provide.
- "Subscriber" refers to any individual or entity that has purchased a subscription to use the Software.
- "Free Trial" refers to the 14-day evaluation period during which you may use the Software at no cost.
2. License Grant
Subject to these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software at one physical business location per subscription. You may install the Software on unlimited devices within that single location (e.g., multiple POS terminals and kitchen displays).
3. Free Trial
We offer a 14-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial period, you must purchase a subscription to continue using the Software. We reserve the right to modify or discontinue the free trial at any time.
4. Subscription & Payment
- The Software is offered on a monthly subscription basis at $10 USD per month per location.
- Payment is processed through our third-party payment provider (e.g., Stripe). You agree to provide accurate and complete billing information.
- Subscriptions automatically renew each month unless cancelled before the next billing date.
- All fees are quoted in US Dollars. You are responsible for any applicable taxes in your jurisdiction.
- We reserve the right to change pricing with 30 days' advance notice. Existing subscribers will be notified via email before any price change takes effect.
5. Cancellation & Refunds
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will not be charged again.
- There are no cancellation fees and no long-term contracts.
- If you are unsatisfied within the first 30 days of a paid subscription, contact us at hello@mezbanpos.com for a full refund.
- Refunds are not available after the 30-day window, except where required by applicable law.
6. Permitted Use
You agree to use the Software only for its intended purpose — managing point-of-sale operations at a legitimate food service business. You agree not to:
- Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Software.
- Copy, redistribute, sublicense, rent, or lease the Software to any third party.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Use the Software for any unlawful purpose or in violation of any applicable laws.
- Attempt to circumvent the license management or trial period restrictions.
- Use automated tools (bots, scrapers) to interact with our Website in a way that degrades service for others.
7. Your Data
MezbanPOS is an offline-first application. All business data (orders, menu, customers, reports) is stored locally on your machine and is never transmitted to our servers. You are solely responsible for:
- Backing up your data regularly (the Software includes built-in backup tools).
- Securing your devices and local network.
- Complying with data protection laws applicable to your customers' personal data.
We have no access to, and assume no liability for, your business data.
8. Intellectual Property
The Software, Website, documentation, logos, and all related materials are owned by MezbanPOS and are protected by copyright and intellectual property laws. Your subscription grants you a license to use the Software — it does not transfer ownership of any intellectual property.
9. Software Updates
We may release updates, patches, and new features from time to time. Updates are included in your subscription at no additional cost. We are not obligated to provide any specific features, updates, or a particular release schedule.
10. Support
Subscribers receive email support at hello@mezbanpos.com. We aim to respond within 1–2 business days. We do not guarantee resolution of all issues and do not offer phone support at this time. Community support resources may be made available in the future.
11. Disclaimer of Warranties
The Software and Website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose.
- Uninterrupted, error-free, or secure operation.
- Accuracy or reliability of any results obtained from the Software.
We do not warrant that the Software will meet your specific requirements or that any defects will be corrected.
12. Limitation of Liability
To the maximum extent permitted by applicable law, MezbanPOS and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising from:
- Your use of (or inability to use) the Software or Website.
- Data loss or corruption on your local machine.
- Unauthorized access to your devices or network.
- Any third-party actions, products, or services.
Our total aggregate liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Termination
We may suspend or terminate your license if you violate these Terms. Upon termination:
- Your license to use the Software is immediately revoked.
- You must uninstall and delete all copies of the Software.
- Your locally stored data remains yours — we cannot and do not delete it.
- No refund is owed for the current billing period if termination is due to a Terms violation.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MezbanPOS operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
16. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via email to active subscribers. Continued use of the Software after changes constitutes acceptance of the updated Terms.
